Furthermore, a custom program was created so all information could be exported into an Excel file for easier transfer between AmeriSciences and Appellants.

At trial, appellants objected to an expert witness’s testimony on several grounds; however, the district court denied their requests to exclude his evidence under Daubert criteria. According to appellants’ argumentation, his methods are flawed and therefore should have been excluded as evidence under Daubert principles. They further contend that the district court made an error when it failed to admit this evidence and improperly excluded lost profits and indirect costs that helped determine the total damages awarded by a jury. At trial, the court determined that all four Appellants were jointly and severally liable for misappropriation of trade secrets, tortious interference with contracts, unjust enrichment and fraudulent transfer; this decision was later upheld by the Fifth Circuit Court of Appeals and awarded Rodney Tow of AmeriSciences a compensatory damages award of $3,461,166.
